These Terms of Use (“Terms”) govern access to and use of https://www.chat.t36.in/ and the services made available through it, including tools that help authorised businesses manage and automate communications on Facebook, Instagram, Messenger, and other supported channels (collectively, the “Service”).

By creating an account, connecting a social-media account, authorising permissions, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you use the Service on behalf of a company, organisation, client, Facebook Page, Instagram professional account, or other legal entity, you confirm that you are authorised to bind that entity to these Terms.

1. SERVICE DESCRIPTION

The Service enables eligible users to connect supported business accounts and use features such as inbox management, automated replies, comment and direct-message automation, chatbot workflows, lead collection, customer-support tools, conversation management, analytics, and related business communication functions.

Features may depend on third-party platforms and the permissions approved by those platforms. We do not guarantee that every feature, permission, integration, or third-party service will always remain available.

2. ELIGIBILITY AND BUSINESS AUTHORITY

You must be legally capable of entering into a binding agreement and must meet the minimum age required by applicable law. The Service is intended for businesses, professionals, and persons acting with proper authority for the connected accounts.

You may connect or manage only those Facebook Pages, Instagram accounts, Messenger accounts, or other assets that you own or are expressly authorised to administer. You must not connect, access, monitor, or control any account without lawful authority and the account owner’s permission.

3. META PLATFORM PERMISSIONS AND PLATFORM DATA

When you connect a Facebook or Instagram account, the Service may request only those permissions reasonably required to provide the features you choose to use. Depending on the enabled features and permissions granted, the Service may process information such as:

  • basic account, Page, or Instagram professional-account identifiers;
  • Page names, usernames, profile information, and connected business-asset information;
  • messages, message metadata, comments, mentions, replies, and conversation content;
  • lead information voluntarily submitted through conversations or forms;
  • access tokens and technical authorisation information required to maintain the connection;
  • insights, engagement information, and other data made available through approved Meta permissions.

We process data received from Meta Products (“Platform Data”) only to provide, secure, maintain, support, and improve the user-facing features described in the Service and our Privacy Policy. We do not use Platform Data for purposes that are materially unrelated to the functionality disclosed to users.

We do not sell Platform Data. We do not transfer Platform Data to data brokers, advertising networks, or unrelated third parties. Platform Data may be shared only with authorised service providers that help us operate the Service, where required by law, to protect rights and security, or as otherwise permitted by Meta’s applicable terms and policies.

Your use of Facebook, Instagram, Messenger, and related Meta Products is also subject to the applicable Meta terms and policies. You agree not to use the Service in a way that violates Meta Platform Terms, Meta Developer Policies, Community Standards, Instagram Terms, applicable messaging rules, or any other requirements imposed by Meta.

4. USER CONTENT AND COMMUNICATIONS

You retain ownership of content, messages, automation instructions, prompts, media, business information, and other material that you submit to or process through the Service (“User Content”).

You grant us a limited, non-exclusive right to host, process, transmit, display, and use User Content only as necessary to operate, secure, support, and improve the Service and to perform the actions you configure.

You are responsible for the accuracy, legality, and appropriateness of your User Content and automated communications. You must ensure that your messages, replies, promotions, and data-collection practices comply with applicable laws, platform rules, consumer-protection requirements, and any consent or notice obligations that apply to your business.

5. AUTOMATED AND AI-ASSISTED RESPONSES

The Service may generate or send automated and AI-assisted responses based on your settings, prompts, connected data, and workflow configuration. Automated output may occasionally be incomplete, incorrect, delayed, or unsuitable for a particular situation.

You are responsible for reviewing and configuring your automations, maintaining appropriate human oversight, and ensuring that automated messages do not make unlawful, deceptive, discriminatory, unsafe, or unauthorised claims. The Service must not be used as a substitute for professional legal, medical, financial, emergency, or other regulated advice.

6. ACCEPTABLE USE

You must not use the Service to:

  • send spam, unsolicited bulk messages, deceptive promotions, or communications prohibited by applicable platform rules;
  • impersonate another person or business, misrepresent affiliation, or use misleading identities;
  • collect, use, disclose, or retain personal data without a lawful basis, required notice, or valid consent;
  • request or process passwords, payment-card details, government identifiers, health information, or other sensitive information unless lawfully permitted and appropriately secured;
  • harass, threaten, discriminate against, exploit, or unlawfully profile individuals;
  • publish or distribute illegal, infringing, fraudulent, malicious, hateful, sexually exploitative, or harmful content;
  • circumvent platform limitations, access controls, rate limits, security controls, or permission requirements;
  • reverse engineer, scrape, probe, attack, disrupt, overload, or compromise the Service or connected platforms;
  • sell, licence, disclose, or misuse Platform Data except as expressly authorised by the data subject, applicable law, and platform policies;
  • use permissions or Platform Data for surveillance, eligibility decisions, credit decisions, employment decisions, insurance decisions, or other prohibited purposes.

7. ACCOUNT SECURITY

You are responsible for safeguarding your login credentials, connected-account permissions, access tokens, and administrator access. You must promptly notify us if you suspect unauthorised access, credential compromise, or misuse of your account.

You must provide accurate account information and keep it current. We may suspend access where reasonably necessary to investigate security incidents, policy violations, fraudulent activity, or risks to users, connected platforms, or the Service.

8. DATA PROTECTION AND SECURITY

Our collection, use, retention, disclosure, and deletion of personal information and Platform Data are described in our Privacy Policy. We use reasonable administrative, technical, and organisational safeguards designed to protect information against unauthorised access, alteration, disclosure, loss, and misuse.

No internet-based system can be guaranteed to be completely secure. You are responsible for using appropriate security settings, granting access only to authorised team members, and avoiding the submission of information that is not necessary for your use of the Service.

9. DISCONNECTION, REVOCATION, AND DATA DELETION

You may stop the Service from accessing a connected Meta account by disconnecting the integration within the Service, removing the app through the applicable Facebook or Instagram settings, or revoking the permissions granted to the app.

You may request deletion of your account and associated personal data by contacting us at rishabgoyalcp@gmail.com or by using any data-deletion page or mechanism made available on https://www.chat.t36.in/.

After receiving and verifying a valid deletion request, we will delete or de-identify the relevant data within a reasonable period, except where retention is required for legal compliance, fraud prevention, security, dispute resolution, financial records, or enforcement of these Terms. Data stored in backups may remain temporarily until the relevant backup is securely overwritten under our normal retention cycle.

If Meta sends us a valid user-data deletion request or deletion callback, we will process the request and delete the associated Platform Data in accordance with applicable Meta requirements and law.

10. SERVICE PROVIDERS AND THIRD-PARTY SERVICES

We may use hosting, database, security, analytics, communication, AI-processing, customer-support, and infrastructure providers to operate the Service. Such providers may process information only for contracted service purposes and are expected to protect it appropriately.

The Service may link to or interoperate with third-party services. We are not responsible for third-party services, their availability, or their independent privacy and security practices. Your use of those services is governed by their own terms.

11. SUBSCRIPTIONS, BILLING, AND REFUNDS

If you purchase a paid plan, you agree to pay the applicable fees, taxes, and charges shown at the time of purchase. Plan limits, billing periods, renewal conditions, and included features will be displayed on the relevant pricing or checkout page.

Unless otherwise stated in writing or required by law, fees already paid are non-refundable once the relevant subscription period or digital service has begun. We may change pricing prospectively after providing reasonable notice where required.

12. INTELLECTUAL PROPERTY

The Service, including its software, interface, branding, design, documentation, and original content, is owned by or licensed to the operator of https://www.chat.t36.in/ and is protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your legitimate internal business purposes. You may not copy, resell, sublicense, distribute, modify, or create derivative works from the Service except where expressly authorised in writing.

13. SUSPENSION AND TERMINATION

You may stop using the Service at any time. We may restrict, suspend, or terminate access if you breach these Terms, misuse Platform Data, violate third-party platform rules, create security or legal risk, fail to pay applicable charges, or use the Service in a way that may harm users, us, Meta, or another third party.

Where reasonably possible, we will provide notice and an opportunity to correct the issue. Immediate action may be taken where necessary to address fraud, unlawful activity, security threats, platform-policy violations, or urgent risks.

14. DISCLAIMERS

The Service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or compatible with every device, account, permission, browser, platform, or third-party service.

We do not guarantee specific sales, lead volumes, response rates, account approvals, Meta permission approvals, platform availability, or business results. Meta and other third-party platforms independently control their products, permissions, reviews, APIs, policies, and enforcement decisions.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunities, or anticipated savings arising from use of or inability to use the Service.

To the maximum extent permitted by law, our total aggregate liability arising from the Service will not exceed the amount paid by you to us for the Service during the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

16. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless the operator of https://www.chat.t36.in/ from third-party claims, losses, liabilities, and reasonable expenses arising from your User Content, your automated communications, your unlawful use of personal data or Platform Data, your violation of platform rules, or your breach of these Terms.

17. CHANGES TO THE SERVICE OR THESE TERMS

We may update the Service and these Terms to reflect changes in features, laws, security requirements, business operations, or third-party platform policies. The updated date will be shown at the top of this page. Material changes may also be communicated through the Service or by email where appropriate.

Continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to a material change, you should stop using the Service and disconnect your connected accounts.

18. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights, courts having jurisdiction over the operator’s registered office in India will have exclusive jurisdiction over disputes arising from these Terms or the Service.

Before filing a formal claim, both parties agree to attempt in good faith to resolve the dispute by written notice and reasonable discussion.

19. GENERAL TERMS

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a merger, restructuring, acquisition, sale of assets, or transfer of the Service.
